Submit your objection within 6 weeks
You have 6 weeks to file an objection, starting from the day after the date of our decision. If you submit your objection too late, VertiCer may decide not to process it. Do you need more time to fully prepare your objection? In that case, submit a preliminary (pro forma) objection within the deadline. You will then have the opportunity to supplement it.
Who can file an objection?
You can file an objection on your own behalf. Does the decision concern your business or association? Then you must file the objection on behalf of that organization. You can also authorize someone to file an objection on your behalf.
What happens after you file an objection?
Upon receipt, we will send you a confirmation of receipt via email. If your objection is incomplete or we need additional information, you will be notified. You must respond within the specified timeframe so that we can proceed with processing your objection.
Hearing
VertiCer may invite you to a hearing. During this hearing, you will explain your objection and we may ask questions. The hearing will take place via a video call or at our office. You may bring someone along for support. No decision will be made during the hearing. Afterward, we will review your objection.
When will you receive a decision?
You will receive a decision on your objection within 12 weeks, calculated from the date of the decision you are objecting to. If more time is needed, VertiCer may extend this period once
Filing an Appeal
If you disagree with our decision on your objection, you may file an appeal. You have up to 6 weeks from the date of our decision letter to do so. For more information about the appeal process, please visit Rechtspraak.nl.
Issuing a Notice of Default
Has the deadline for making a decision passed and have you not yet received a response to your objection? Then you can issue a notice of default to VertiCer. You can do this by sending an email to [email protected] with the following information: name and address, date of the objection, a description of the decision for which you are issuing the notice of default to VertiCer, and the reasons for the notice of default.
Don’t forget to sign your notice of default.
Upon receipt, we will send you a confirmation via email. We will then verify whether the decision deadline has indeed expired. Has the deadline passed? If so, VertiCer still has 2 weeks to make a decision. If they are unable to decide within those 2 weeks, you are entitled to a penalty payment. The amount depends on how long the decision is delayed.
Withdrawing your objection
Do you wish to withdraw your objection? You may do so at any time. You can withdraw your objection in writing or via email: [email protected]. If you withdraw your objection, the proceedings will end without us issuing a decision on the objection. Please note that you will no longer be able to file an appeal afterward, as there will be no decision against which you can appeal.
